Château La Paz - Vacation Rental 

Atascadero, CA

 

Effective Date: August 26, 2026

 

These Terms & Conditions (“Terms”) govern the rental and use of Chateau La Paz (“Property”), located in Atascadero, California. By making a reservation, the guest (“Guest,” “you,” or “your”) agrees to these Terms on behalf of all members of the rental party.

1. PROPERTY & HOST

The Property is offered for temporary vacation and short-term accommodation, subject to applicable law and the terms of the reservation.

2. RESERVATION REQUIREMENTS 

The person making a reservation must be at least 18 years of age and must provide accurate and complete information.

The Guest agrees that:

  • The reservation information is truthful and complete.

  • The Guest is responsible for all members of the rental party and their conduct.

  • The Property will be used only for the purpose disclosed at booking.

  • The reservation may not be sold, transferred, assigned, or sublet without the Host’s prior written approval.

  • The Guest will comply with these Terms and all applicable laws, regulations, and Property rules.

A reservation becomes confirmed only when the required payment and other booking requirements have been satisfied.

The Host reserves the right to decline or cancel a reservation when permitted by law if material information provided by the Guest is inaccurate, incomplete, fraudulent, or misleading.

3. OCCUPANCY

 

The maximum permitted occupancy is [NUMBER] guests.

Only the individuals identified in the reservation may stay overnight at the Property unless the Host has provided prior written approval.

The Guest may not exceed the Property’s permitted occupancy or applicable legal occupancy limits.

Any unauthorized overnight guests may result in additional charges and/or cancellation of the reservation, subject to applicable law.

4. Reservation 

The total reservation price will be disclosed before the Guest completes the booking.

Depending on the reservation, charges may include:

  • Accommodation charges

  • Cleaning fees

  • Applicable taxes

  • Deposits

  • Approved pet fees

  • Approved event or additional-guest fees

  • Other charges disclosed before booking

Payment must be made according to the payment schedule provided at the time of reservation.

If a required payment is not received when due, the Host may cancel the reservation to the extent permitted by the applicable cancellation policy and law.

5. CANCELLATION POLICY 

The cancellation policy applicable to a reservation will be clearly disclosed to the Guest before the reservation is completed.

For direct bookings, the applicable cancellation policy is:

For reservations made through Airbnb, Vrbo, or another booking platform, the cancellation policy displayed and accepted through that platform will apply, subject to applicable law.

Guests are strongly encouraged to obtain travel insurance that may provide coverage for qualifying cancellations, interruptions, illness, travel delays, emergencies, weather events, or other covered circumstances.

6. CHECK-IN & CHECK-OUT

Check-In: 3 P.M.


Check-Out: 11 A.M.

Early check-in and late check-out are available only when specifically approved by the Host.

Unauthorized early arrival or late departure may result in an additional fee where permitted by law.

 

At check-out, Guests must:

  • Vacate the Property by the designated check-out time.

  • Remove personal belongings.

  • Place trash in the designated containers.

  • Wash or load dishes as instructed.

  • Return keys, remotes, access devices, and other Property items as instructed.

  • Leave the Property in reasonably tidy condition.

  • Follow any additional check-out instructions provided by the Host.

7. PROPERTY CARE 

Chateau La Paz is a privately owned vacation home and should be treated with the same care and respect that Guests would expect in their own home.

 

Guests are responsible for reasonable care of:

 

  • Furniture

  • Appliances

  • Linens and towels

  • Artwork and décor

  • Electronics

  • Outdoor furniture

  • Landscaping

  • Pool/spa equipment

  • Kitchen equipment

  • Keys and access devices

  • All other Property amenities

Guests must promptly notify the Host of damage, malfunction, water leaks, safety concerns, or other issues discovered during the stay.

Guests may not move, remove, alter, disassemble, or replace Property furnishings or equipment without permission.

8. DAMAGE, LOSS & EXCESSIVE CLEANING

The Guest is responsible, subject to applicable law, for damage or loss caused by the Guest or any member of the Guest’s party.

This may include damage to the Property, furnishings, appliances, landscaping, outdoor amenities, or other Property items.

Guests may also be responsible for reasonable additional cleaning or restoration costs caused by conditions beyond ordinary vacation-rental turnover, including:

  • Excessive trash

  • Excessive dirt or debris

  • Food or beverage stains

  • Bodily-fluid contamination

  • Unauthorized smoking

  • Pet-related damage or excessive pet hair

  • Furniture or mattress damage

  • Damage requiring specialized cleaning

  • Unauthorized alterations or movement of furniture

The Host will provide documentation of claimed damage or additional charges when required by applicable law.

9. SECURITY DEPOSIT 

If a security deposit or damage authorization is required, the amount and applicable terms will be disclosed before booking.

Any deposit or damage-related deduction will be handled in accordance with applicable California law.

Nothing in these Terms is intended to waive any rights or obligations concerning security deposits that cannot legally be waived.

10. PARTIES, EVENTS, & GATHERINGS

Chateau La Paz is a vacation rental, not an unrestricted event venue.

Parties, weddings, receptions, corporate events, commercial productions, large gatherings, or other events require the Host’s prior written approval.

A Guest may not represent that an event is approved unless the Host has provided written confirmation.

 

Any approved event may be subject to:

  • Additional fees

  • Guest or attendance limits

  • Parking requirements

  • Noise restrictions

  • Additional cleaning requirements

  • Security requirements

  • Insurance requirements

  • Vendor requirements

  • Additional written conditions

Unauthorized events or gatherings may result in cancellation of the reservation and/or additional charges, subject to applicable law.

11. NOISE & NEIGHBOR CONSIDERATION 

Guests must respect the surrounding community.

Excessive noise, amplified music, shouting, disruptive conduct, or behavior that unreasonably disturbs neighbors is prohibited.

Guests must comply with all applicable City of Atascadero noise requirements and any quiet hours communicated by the Host.

The Host may take reasonable action in response to verified complaints or significant disturbances, including contacting the Guest or appropriate authorities where necessary.

12. SMOKING & VAPING 

Smoking and vaping are not permitted inside Chateau La Paz.

Smoking or vaping is permitted only in designated outdoor areas, if any, and must comply with applicable fire-safety requirements.

Cigarettes, cigars, ashes, and other smoking materials must be fully extinguished and disposed of safely.

Smoking inside the Property may result in reasonable additional cleaning, deodorizing, or restoration charges, subject to applicable law.

13. PET POLICY 

Pets are welcome with prior approval and a flat fee. Guests are responsible for preventing pets from damaging the Property, furniture, landscaping, or other amenities and must promptly clean up pet waste.

Service animals and other legally protected animals will be accommodated as required by applicable law.

14. CHILDREN & SUPERVISION

Guests are responsible for appropriately supervising children and other members of their party.

The property may contain stairs, fireplaces, outdoor areas, hot surfaces, and other conditions that may present risks.

Parents and guardians remain responsible for the supervision and safety of minors in their care.

15. FIRE SAFETY 

Guests must exercise reasonable care regarding fire and heat sources.

Unless specifically authorized, Guests may not use fireworks, firecrackers, unauthorized outdoor fires, or other hazardous materials on the Property.

Guests must not disable, remove, cover, or tamper with smoke detectors, carbon monoxide detectors, fire extinguishers, alarms, or other safety equipment.

During periods of elevated wildfire danger, Guests must comply with all applicable fire restrictions and instructions from governmental authorities.

17. ILLEGAL ACTIVITY

The Property may not be used for unlawful activity.

Illegal drug activity, criminal conduct, unauthorized commercial activity, or other unlawful use of the Property is prohibited.

Nothing in these Terms authorizes conduct that violates federal, state, county, or local law.

18. WEAPONS

Guests must comply with all applicable federal, state, and local laws regarding firearms and other weapons.

No unlawful weapon or unlawful use of a weapon is permitted at the Property.

19. PARKING & VEHICLES

Guests must use only designated parking areas.

Vehicles may not:

  • Block driveways or access areas.

  • Block emergency access.

  • Park on neighboring property without permission.

  • Damage landscaping.

  • Obstruct roads or rights-of-way.

The maximum number of vehicles permitted is 20, unless otherwise approved.

Oversized vehicles, trailers, recreational vehicles, boats, or other specialty vehicles require prior written approval.

20. INTERNET & TECHNOLOGY

Wi-Fi and internet access is provided as a convenience.

The Host does not guarantee uninterrupted availability, speed, compatibility, or security of internet service.

Guests agree not to use the Property’s internet or technology systems for unlawful activity, copyright infringement, hacking, harassment, fraud, or other prohibited conduct.

21. MAINTENANCE & AMENITIES

The Host makes reasonable efforts to keep Chateau La Paz and its amenities in good working condition.

Occasional interruptions or failures involving utilities, internet service, appliances, landscaping, HVAC systems, or other amenities may occur.

Guests must promptly report maintenance issues rather than attempting major repairs themselves.

The Host will make reasonable efforts to address reported issues as promptly as practicable.

22. HOST & PROPERTY MANAGER ACCESS

The Host, property manager, maintenance personnel, contractors, or other authorized persons may enter the Property when permitted by applicable law, including when reasonably necessary for:

  • Emergencies

  • Repairs

  • Maintenance

  • Inspections

  • Safety concerns

  • Protection of the Property

  • Necessary services

Except in emergencies or other circumstances permitted by law, appropriate notice will be provided when required.

23. PERSONAL BELONGINGS 

Guests are responsible for their personal belongings.

The Host is not responsible for lost, stolen, damaged, or abandoned personal property except to the extent liability cannot legally be excluded.

Guests should secure valuables and avoid leaving important personal items unattended.

24. LOST & FOUND

Guests should thoroughly inspect the Property before departure.

If an item is found after departure, the Host may contact the Guest regarding its return.

Shipping or handling costs may be charged to the Guest when permitted.

The Host is not responsible for items left behind except as required by applicable law.

25. EMERGENCIES & UNFORSEEN CONDITIONS

Guests should immediately contact emergency services by calling 911 when there is an emergency requiring police, fire, or medical assistance.

The Host is not responsible for circumstances beyond the Host’s reasonable control, including natural disasters, wildfire, severe weather, utility outages, governmental orders, road closures, public emergencies, or other extraordinary circumstances.

If circumstances make the Property unavailable or unsafe for occupancy, the Host will act in accordance with applicable law and the terms of the applicable reservation.

26. COMPLIANCE WITH ATASCADERO REQUIREMENTS 

Chateau La Paz operates subject to applicable laws, regulations, permits, licenses, and requirements governing vacation rentals in Atascadero, California.

Guests agree to comply with all applicable requirements.

The City of Atascadero currently identifies vacation rentals as short-term accommodations of 30 days or less and maintains licensing and transient-occupancy-tax requirements for applicable vacation rentals. (City of Atascadero)

The Host reserves the right to update Property rules when reasonably necessary to comply with changes in applicable law or regulation.

27. TAXES & GOVERNMENTAL CHARGES

Applicable transient occupancy taxes, assessments, fees, and other governmental charges will be collected from the Guest when required.

Atascadero currently publishes a combined transient-occupancy-related rate of 14% for applicable lodging, consisting of 10% TOT, 2.5% Atascadero Tourism Business Improvement District assessment, and 1.5% San Luis Obispo County Tourism Marketing District assessment. Rates and applicable requirements may change. (City of Atascadero)

The amount charged to a particular reservation will reflect the taxes and assessments applicable at the time of booking.

28. NO SUBLETTING OR COMMERCIAL USE

Guests may not sublease, resell, assign, or transfer their reservation without written authorization.

Commercial photography, filming, advertising production, professional events, or other commercial uses require prior written approval.

29. ACCESSIBILITY & INDIVIDUAL NEEDS

Guests who require specific accessibility accommodations are encouraged to contact the Host before booking so that available features and limitations can be discussed.

The Host will comply with applicable accessibility and nondiscrimination requirements.

Guests should not assume that a particular accessibility feature is available unless it has been confirmed by the Host.

30. PRIVACY

Information collected through the Chateau La Paz website or reservation process will be handled in accordance with the Property’s applicable Privacy Policy.

Guest information may be used as reasonably necessary to process reservations, communicate with Guests, provide services, comply with legal requirements, prevent fraud, maintain the Property, and administer the rental.

31. WEBSITE INFORMATION

The Chateau La Paz website may contain photographs, descriptions, amenities, availability, pricing, and other information about the Property.

The Host makes reasonable efforts to keep website information accurate but does not guarantee that every photograph, description, amenity, or feature will remain unchanged.

Furniture, décor, landscaping, amenities, technology, and other features may occasionally change.

32. RIGHT TO REFUSE OR TERMINATE A STAY

To the extent permitted by applicable law, the Host may refuse or terminate a reservation when necessary because of:

  • Material misrepresentation by the Guest

  • Unauthorized occupancy

  • Unauthorized parties or events

  • Illegal activity

  • Significant property damage

  • Serious or repeated violations of these Terms

  • Threats to the safety of Guests, neighbors, employees, contractors, or the Property

Any cancellation or termination will be handled in accordance with applicable law and the applicable reservation terms.

33. NO WAIVER

If the Host does not immediately enforce a particular provision of these Terms, that does not constitute a waiver of the Host’s right to enforce that provision in the future.

34. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

35. GOVERNING LAW

These Terms are governed by the laws of the State of California, except where applicable law requires otherwise.

Nothing in these Terms is intended to eliminate, restrict, or waive a right or protection that cannot legally be waived.

36. CHANGES TO THESE TERMS

The Host may update these Terms from time to time.

The version applicable to a reservation will generally be the version provided to or accepted by the Guest at the time of booking, except where an update is required by law or applies to matters occurring after the update.

The current version will be made available on the Chateau La Paz website.

37. GUEST ACKNOWLEDGMENT

By making a reservation or occupying Chateau La Paz, the Guest acknowledges that they:

  1. Have read and understood these Terms & Conditions.

  2. Agree to comply with these Terms.

  3. Accept responsibility for the conduct of everyone in their rental party.

  4. Agree to comply with applicable laws and Property rules.

  5. Understand that violations may result in additional charges or termination of the reservation when permitted by law.
